Description
Is it a hobby or is it a business? Many people ?nd that they do something enjoyable that can also generate income, but is it truly a business? IRC §183, Activities not engaged for pro?t, is used to distinguish between hobbies and legitimate business activities.
The IRS and Tax Court use a nine-factor test when deciding whether a business is motivated by pro?t or if it’s the taxpayer’s hobby. The taxpayer does not need to meet all nine factors to show that they have a legitimate business, but they certainly need to have a majority. Over the course of this session, you will go over each of the nine factors from a business management approach and apply it to our tax practices to see how you can improve your practice and make sure you are never looked upon as a hobby or not-for-pro?t activity.

1. Learn about the 9 factors that distinguish a business from a hobby.
2. Determine how to use the 9 factors to evaluate your client's business.
3. Understand how to establish a plan for your business with Section 183 in mind.
